These Terms and Conditions govern your use of the Longspan website and the services we provide. By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our website or engage our services. Questions may be directed to [email protected].
1. Definitions
- Agreement — these Terms and Conditions, together with any written service engagement agreement.
- Service — any workshop, coordination, or indexing service offered by Longspan.
- User / Client / You — any individual accessing our website or engaging our services.
- We / Us / Our — Longspan, operating from 7 Jalan Gaya, 88000 Kota Kinabalu, Sabah, Malaysia.
- Content — all materials, workbooks, indexes, summaries, and outputs produced in connection with our services.
2. Acceptance of Terms
By using our website or confirming a service booking, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and accept these Terms and Conditions in full. If you are engaging services on behalf of another person, you warrant that you are authorised to do so.
3. Service Description
Longspan provides clerical organisation and educational services relating to retirement and provident fund records. Our services are:
- Documents Readiness Workshop — a half-day educational group session
- Household Records Index — a two-appointment clerical indexing service
- Long Paper Trail Coordination — a three-month records coordination engagement
Our services do not constitute financial advice, legal advice, or any form of professional representation. No opinion on the meaning, validity, or effect of any document is given at any point. Services are available in Kota Kinabalu, Sabah, with limited remote delivery options for workshop materials.
4. Bookings and Payment
Service bookings are confirmed on receipt of a 50% deposit. The remaining balance is due on the day of the final handover or workshop session. All fees are quoted and charged in Malaysian Ringgit (RM). Payment may be made by bank transfer or cash at our office.
Current fees: Documents Readiness Workshop RM 425 per participant; Household Records Index RM 1,240 per household; Long Paper Trail Coordination RM 3,870 per engagement. Fees are subject to change; the fee applicable to your booking is that confirmed in writing at the time of booking.
5. Cancellations and Refunds
- Cancellation more than 7 days before the first appointment or workshop date: full deposit refunded.
- Cancellation within 7 days of the first appointment or workshop date: deposit is forfeited.
- If Longspan cancels a session due to unforeseen circumstances, a full refund of any deposit paid will be issued.
- Once a Long Paper Trail engagement has commenced (first appointment completed), no refund of paid amounts is available.
6. User Responsibilities
As a client, you agree to:
- Provide accurate information about your documentation and situation
- Retain custody of all original documents at all times during our engagement
- Not rely on any statement made by a Longspan coordinator as financial, legal, or professional advice
- Contact qualified professionals for interpretation of documents or decisions regarding entitlements
- Treat all workbook materials, indexes, and summaries as administrative aids only
7. Intellectual Property
All workbook templates, index structures, and methodologies developed by Longspan are our intellectual property. Clients receive a personal, non-transferable licence to use the printed materials produced for their own engagement. Materials may not be reproduced for commercial use or shared with third parties without written permission.
8. Disclaimers
Our services are provided on an "as is" basis. We make no representation that:
- Any document we help you organise will result in a particular outcome with any third party
- The completion of our service will satisfy the requirements of any particular fund, employer, or professional
- Information contained in any workbook or handout constitutes professional guidance for your individual circumstances
9. Limitation of Liability
To the maximum extent permitted by Malaysian law, Longspan's total liability for any claim arising from or in connection with our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or special loss. Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud.
10. Confidentiality
Longspan treats all documents and personal information encountered during an engagement as confidential. We will not disclose your information to third parties except as required by law or with your explicit written consent. Coordinators are bound by confidentiality agreements as a condition of their engagement with Longspan.
11. Termination
Either party may terminate a service engagement in writing with 7 days' notice. Longspan reserves the right to terminate an engagement immediately if a client provides materially false information, behaves in a way that endangers the safety of coordinators, or requests that coordinators act outside the scope of the agreed service. In such cases, refunds will be assessed on the basis of work completed.
12. Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from them shall first be addressed through informal negotiation. If unresolved within 30 days, disputes shall be referred to mediation under the Mediation Act 2012 (Malaysia) before any legal proceedings are commenced. The courts of Sabah shall have non-exclusive jurisdiction.
13. General Provisions
- Entire Agreement: These terms, together with any written service agreement, constitute the entire agreement between us.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these terms without our written consent.
- Notices: Formal notices should be sent by email to [email protected] or by post to 7 Jalan Gaya, 88000 Kota Kinabalu, Sabah.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. The "Last Updated" date at the top of this page will reflect the most recent revision. For ongoing service engagements, material changes will be notified in writing.
